If spouses have particular issues that cannot be easily resolved, divorce mediation may be the right choice to help form an agreement. Divorce mediation actually requires only one attorney, but both spouses can have their own attorney.

The purpose of divorce mediation is to form an agreement. That agreement is then binding on the parties upon approval of the court. Enforcement of a mediated agreement follows the same legal process as enforcement of any other divorce and court order. A court can set a stipulated agreement aside, rule that it is invalid, and proceed without regard to the agreement. Courts rarely will take such adverse steps when the agreement is fair, equitable, and consistent with state law and court rules. Consequently, it is wise to utilize an attorney’s services during the formation of an agreement to ensure its initial approval, as well as its subsequent enforceability.
